The draft amendment proposes to standardize variety selection, seed production, management, and management, protect new plant variety rights, encourage original breeding innovation, safeguard the legitimate rights and interests of seed producers and users, improve seed quality, and promote seed industrialization and development Modern seed industry guarantees food security and promotes the development of agriculture and forestry.
The draft amendment stipulates that a substantively derived variety refers to a variety that is substantially derived from the original variety, or a variety derived from a substantively derived variety of the original variety. The basic traits produced by the genotype or combination of genotypes of the original variety are the same as those of the original variety. Substantively derived varieties can apply for new plant variety rights and obtain authorization. The implementation list and determination guidelines of substantive derived varieties shall be determined by the competent department of agriculture, rural areas, forestry and grassland under the State Council in accordance with the Seed Law and relevant laws.
